These Terms of Service govern your use of the HiveRewards platform, website, and related services operated by Hive Rewards Marketing Inc. ("HiveRewards", "we", "us", or "our"). By accessing or using our services, you agree to these terms.
1. Who we are
HiveRewards is a technology platform that guides homebuyers through the real estate purchase process and facilitates cashback arrangements with licensed real estate and mortgage professionals. We are not a real estate brokerage or mortgage brokerage. All licensed professional services are provided by our partner professionals operating under their own licences and regulatory obligations.
2. Eligibility
You must be 18 years of age or older and a resident of Canada to use our services. By registering, you confirm that you meet these requirements.
3. Our services
HiveRewards provides a guided homebuyer journey platform that connects clients with real estate and mortgage professionals. As part of this, we may facilitate cashback payments to clients, funded by the participating professionals out of the client-acquisition budgets they already spend to find clients. This cashback is not a share of any real estate commission or professional fee, and it is not paid by the client. Cashback amounts are estimates only and depend on the final purchase price, mortgage amount, and the specific professionals involved in your transaction.
We do not guarantee any specific cashback amount, timeline, or outcome. All cashback is subject to the successful closing of a transaction and the terms agreed upon with the relevant partner professionals.
4. Your account
You are responsible for keeping your account information accurate. You agree not to share your portal access link with anyone not party to your transaction. We reserve the right to suspend or terminate access if these terms are violated.
5. Referrals
If you refer another person to HiveRewards, any referral reward is subject to the referred person successfully completing a transaction through our platform. We reserve the right to modify or discontinue referral incentives at any time.
6. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these terms by reference.
7. Intellectual property
All content, design, and software on the HiveRewards platform is the property of Hive Rewards Marketing Inc. You may not reproduce, distribute, or use our content without written permission.
8. Disclaimer of warranties
Our services are provided on an "as is" basis. We make no warranties, express or implied, regarding the accuracy of information, availability of the platform, or fitness for any particular purpose. We are not liable for decisions made based on information provided through our platform.
9. Limitation of liability
To the maximum extent permitted by applicable law, HiveRewards shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, even if we have been advised of the possibility of such damages.
10. Changes to these terms
We may update these terms from time to time. We will notify registered users of material changes. Continued use of our services after changes constitutes acceptance of the updated terms.
11. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta.
